Advertising Terms

The commercial terms that apply to quotations, creative production and campaign delivery.

Scope

These Advertising Terms apply to campaign strategy, creative production, media placement, streaming advertising, sponsorships and related services supplied by Kora Media and Advertising (Pty) Ltd. A signed quotation, insertion order, statement of work or written acceptance may add to or change these terms.

Quotations and bookings

Prices, deliverables, dates, media inventory and validity periods are stated in the quotation. A website package price is a starting price and is not a binding offer. A booking is confirmed only after written acceptance and any required deposit or payment. Media inventory remains subject to availability until confirmation.

Client responsibilities

The client must provide accurate instructions, authorised contacts, approvals and materials by the agreed deadlines. The client warrants that it owns or has permission to use all supplied logos, music, footage, images, trademarks, data and claims, and that the advertising is lawful, accurate and not misleading. The client is responsible for required licences, releases and sector-specific approvals unless the written scope assigns them to Kora Media.

Creative production and approval

The quotation states the included creative work and revision rounds. Extra concepts, revisions, formats, reshoots or work caused by late or changed instructions may be quoted separately. Written approval authorises Kora Media to finalise and deliver the material. Corrections after approval may affect cost and schedule.

Media placement

Placements, dates and estimated delivery are subject to technical requirements, platform availability and editorial or brand-safety standards. Kora Media may make a reasonably equivalent adjustment after consulting the client when a booked placement becomes unavailable. Kora Stream Africa is one possible media platform; Kora Media and Advertising remains the contracting advertising company unless the written agreement says otherwise.

Measurement and reporting

Campaign figures are produced from available platform and delivery records. Impressions, clicks, views and completion rates may be affected by filtering, devices, network conditions and third-party systems. Reports are provided in good faith but do not guarantee sales, enquiries, audience behaviour or other commercial outcomes.

Payment

Invoices are payable by the due date and using an enabled payment method. Bank transfer and PayPal payments may require manual confirmation. Kora Media may pause production, withhold files, delay placement or suspend a campaign when an undisputed payment is overdue.

Changes, postponement and cancellation

Requested changes are subject to feasibility, availability and additional cost. Cancellation or postponement must be sent in writing. Work already performed, approved production, non-recoverable supplier costs and committed media may remain payable. Rejection and suspension

Kora Media may reject, remove or suspend material that is unlawful, harmful, discriminatory, deceptive, infringing, technically unsafe, inconsistent with platform standards or likely to damage people, the public or the Kora brands. Where reasonably possible, the client will be given an opportunity to correct the material.

Intellectual property

Each party retains its pre-existing intellectual property. Ownership or licence rights in commissioned creative work are defined in the quotation. Unless agreed otherwise, final usage rights arise only after full payment. Working files, unused concepts, production methods and third-party licensed assets are not transferred unless expressly stated.

Confidentiality and data

Each party must protect confidential business information received for the campaign. Personal information will be handled under the Privacy Policy and applicable law.

Liability and general terms

Neither party is liable for delay caused by events beyond reasonable control. To the extent permitted by law, Kora Media’s aggregate liability arising from a campaign is limited to the fees paid for the affected services, excluding liability that cannot legally be limited. South African law applies. The written campaign agreement and these terms form the entire agreement for the booked services.
